San Francisco - Apple Inc. may face obstacles in a lawsuit to stop the online retailer, Amazon.com Inc., related to use of the trademarked name of Apple's App Store.
The news was demonstrated by a judge in the opinion of the United States on Wednesday (22 / 6).
Apple, iPhone and iPad tablet maker, filed a lawsuit saying that Amazon's improper use of the name of Apple's App Store to collect developers across the United States.
According to someone who followed a hearing in Oakland federal court Wednesday, Judge Phyllis Hamilton said the region would re-read some of the supporting documents in the case.
However, to quote him, Hamilton said that Apple has a "stumbling block" in proving that anyone would be confused with Apple's App Store by Amazon AppStore for Android.
Court records show Hamilton did not make the final decision of the hearing.
According to Reuters, the Apple declined to comment, while Amazon did not immediately respond to requests for comment.
Apple claims in the lawsuit that Amazon uses the name of the App Store with unauthorized in connection with what is called the Amazon as the "Amazon AppStore Developer Portal," along with others such as advertisers for additional versions of popular games Angry Birds.
Apple also asserted claims of unfair competition, and trying to ban the Amazon using the App Store brand. The case was registered in the district court northern district of California, Apple Inc. against Amazon.com Inc., 11-1327
